The Labor Court of the II Judiciary Circuit of San Jose declared the labor union’s strike at the Costa Rican Institute of Alcoholism and Drug Dependence (IAFA) legal.

This is the first of 9 sentences that have been issued that considers the movement to meet all legal requirements. The sentence was given by Judge Angela Keiko Minero Akiya, who stated that “in conformity with the disposition of articles 60 and 61 of the Constitution, 5 of the Organic Law of the Judiciary Branch, 15,428 and others related of the Labor Code, and international norms of the International Labor Organization (ILO), the strike promoted by the National Association of Public Employees (ANEP) is declared legal”.

Yesterday another employee strike, in this case the one concerning the Joint Institute for Social Aid (IMAS) was resolved to be illegal, coinciding with the sentence of employee strikes affecting other 7 public institutions , this sentence was issued by Judge Rudy Enrique Araya Jiménez, who considered that the minimum support to the strike as required by law was not met by the labor union at IMAS.

As in all other cases the resolution received by IAFA can be appealed in a period of no more than three days.
